The legal agreement between you and the Developer governing use of SPACE.
These Terms of Service and End-User License Agreement ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Jakkula Shiva Kumar, an individual developer ("Developer," "we," "us," or "our"), governing your access to and use of the SPACE mobile application ("App") available on the Google Play Store. These Terms are governed by the laws of India, including the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023.
BY DOWNLOADING, INSTALLING, REGISTERING FOR, OR USING THE APP, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS IN THEIR ENTIRETY. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT DOWNLOAD, INSTALL, OR USE THE APP.
These Terms should be read in conjunction with our Privacy Policy, which is incorporated herein by reference.
You must be at least 18 years of age to use the App independently. This is in accordance with the Digital Personal Data Protection Act, 2023 ("DPDPA 2023"), which defines a "child" as any person below the age of 18 and requires verifiable parental consent for processing their personal data.
If you are under 18 years of age, your parent or legal guardian must review these Terms and our Privacy Policy and provide verifiable consent before you use the App, as required under Section 9 of the DPDPA 2023. We do not knowingly allow users under 18 to register without such consent. If we discover a minor has registered without parental consent, we will delete the account promptly. Users under 18 may not make in-app purchases without parental consent.
You may only create one account per person. You must provide accurate, complete, and current information when registering. Creating an account on behalf of another person without their explicit consent is prohibited.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to download, install, and use the App on a device you own or control, solely for your personal, non-commercial purposes.
You agree NOT to: copy, modify, distribute, sell, or transfer any portion of the App; reverse engineer or decompile the App; remove proprietary notices; use the App for commercial purposes without written consent; use automated bots or scripts; or gain unauthorised access to any part of the App or its servers. Any violation may also constitute an offence under the Information Technology Act, 2000.
The App and all its content, features, design, code, databases, trademarks, and branding are the exclusive intellectual property of Jakkula Shiva Kumar, protected under Indian intellectual property laws including the Copyright Act, 1957 and the Trade Marks Act, 1999. All rights not expressly granted are reserved.
You are solely responsible for all activity under your account. Keep your credentials confidential. Notify us immediately at spaceapp.page@gmail.com if you suspect unauthorised access. Unauthorised access to another user's account may constitute an offence under Section 66 of the Information Technology Act, 2000. We reserve the right to terminate or suspend compromised or misused accounts.
Free features include Solo Space habit tracking. Premium features ("SPACE Pro") include: Couple Spaces, Group Spaces, combined streaks, habit snaps within spaces, nudges, shared challenges, full Discover tab access (location-based recommendations and join requests), and leaderboards.
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. Your Google Play account will be charged at the price displayed at time of purchase, inclusive of applicable Indian taxes (GST) where required. You may cancel via the Google Play Store; cancellation takes effect at the end of the current billing period.
ALL PURCHASES ARE FINAL AND NON-REFUNDABLE, except as required by applicable Indian consumer protection law (Consumer Protection Act, 2019) or Google Play's own refund policies. For billing disputes, contact spaceapp.page@gmail.com within 30 days of the charge. EU users retain statutory cancellation rights under the EU Consumer Rights Directive.
You agree NOT to post abusive, harassing, defamatory, or hateful content; engage in hate speech or content prohibited under Indian law (including Sections 153A, 295A, 499, and 509 of the Indian Penal Code / Bharatiya Nyaya Sanhita, 2023); bully or intimidate other users; post explicit or violent content; impersonate any person; collect information about other users without consent; or engage in any activity that disrupts the App or violates the IT Act, 2000.
SPACE allows users to post habit snaps, captions, reactions, and profile information ("User Content"). You retain ownership of your User Content. By posting, you grant us a non-exclusive, royalty-free licence to store, display, and distribute your User Content solely to operate the App. You are solely responsible for ensuring your User Content does not violate any Indian law. Habit snaps auto-expire and are permanently deleted from our servers daily at midnight IST.
The Discover tab relies on your geographic location. By enabling location features, you provide explicit consent to the collection and use of your location data as described in our Privacy Policy, in accordance with the DPDPA 2023. You may disable location features at any time via App or device settings, after which location-based features will be unavailable.
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THE DEVELOPER'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM OR ₹1,000 (WHICHEVER IS HIGHER).
SPACE is a personal productivity and social habit-tracking app, not a medical device or mental health service. Nothing in the App constitutes medical, psychological, or professional advice.
You agree to indemnify and hold harmless Jakkula Shiva Kumar from any claims, damages, losses, liabilities, costs, and expenses arising from: your use of the App; your User Content; your violation of these Terms; your violation of any applicable Indian law; or your violation of any third-party rights.
You may delete your account at any time via Settings > Account > Delete Account, or by contacting spaceapp.page@gmail.com. We reserve the right to suspend or terminate access at any time for violation of these Terms or applicable law, without prior notice where required for legal compliance.
In accordance with the Information Technology Act, 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, any grievance regarding the App or these Terms may be directed to our Grievance Officer:
We may modify the App or these Terms at any time. Material changes will be communicated via in-app notification or email at least 7 days before taking effect. Continued use after changes constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the DPDPA 2023. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India. EU users retain rights under applicable EU consumer protection laws.
